التدابير الوقائية لمكافحة الفساد في الجزائر: بين المقاربة الاجتماعية و القانونية

Résumé: تبنت التشريعات الحديثة في مجال مكافحة الفساد ،المقاربة الوقائية كآلية جديدة للحد من تنامي هذه الظاهرة، فمن أجل الوقاية من الفساد يجب إدراج مختلف الفواعل الاجتماعية التي تساهم في توفير تنشئة اجتماعية سليمة لأفراد المجتمع تسمح بخلق ضمير حي يكون أول درع لمواجهة الفساد . بمقابل ذلك أدرجت هذه التشريعات بما فيها التشريع الجزائري جملة من التدابير الوقائية القانونية التي تضمن نزاهة الموظف العمومي و شفافية الحياة العامة ضمن القطاع العام إلى جانب تدابير لتحصين القطاع الخاص سواء كان شركات أو مؤسسات مالية ومصرفية. Abstract: The new anti-corruption legislation has adopted a preventive approach as a new mechanism to reduce the growth of this phenomenon. In order to prevent corruption, the various social actors that contribute to the provision of a healthy social upbringing to members of society should be included that allows the creation of a living conscience that is the first shield against corruption. On the other hand, this legislation, including Algerian legislation, has included a number of legal safeguards guaranteeing the integrity of the public official and the transparency of public life within the public sector, as well as measures to fortify the private sector, whether it be companies or financial and banking institutions.
