مقاصد الأموال عند فقهاء المالكية

Résumé: ملخص: يعرض هذا المقال جملة من مقاصد المال عند فقهاء المالكية خاصة. ينطلق المقال من إشكالية رئيسية: ما هي المقاصد المالية في المذهب المالكي؟ فيهدف البحث إلى رصد جملة من المقاصد المتعلقة بالمال في المذهب المالكي. في البداية قمت بتعريف كل من المقاصد والمال, ثم تطرقت لمقاصد الرواج والحفظ في الأموال, وأنهيت بقاعدة ذات صلة بالموضوع, يظهر جانبا من التطبيق المقاصدي المالي؛ وهي اعتبار الجنس بالمقاصد؛ إذ قمت بشرحها وذكرت نماذج لتطبيقاتها.ومن نتائج البحث: أهمية مقصد الرواج في تمييز النقد والمال, ومراعاة الشريعة لمقصد حفظ المال لدوره الهام في الحياة. وأيضا من النتائج اعتبار المالكية أن الجنس يمكن أن يبنى على المنفعة والمقصد وليس فقط الصورة الظاهرة له. Abstract: This article presents a set of money intentions, especially for Maliki scholars. The article is based on a major problem: What are the financial intentions in the Maliki school? The research aims to monitor a number of purposes related to money in the Maliki school. Initially I defined both intents and money, then touched upon the aims of popularity and saving money, and I ended with a relevant rule, which appears aside from the financial intentions application; namely, considering gender as intents; I explained them and mentioned models of their applications. Among the results of the research: the importance of the intent of popularity in distinguishing cash and money, and observance of Sharia for the purpose of keeping money for its important role in life. Also, one of the results is that Maliki believes that sex can be built on benefit and purpose, not just the image that appears to him.
