الحق في الحرية والأمان الشخصي وضمان ممارستها في التنظيم الدستوري الفلسطيني

Résumé: يأتي الحق في الحرية والأمان الشخصي في مقدمة الحريّات ويعتبر وجودها شرطاً لوجود الحريات العامة الأخرى،ويمثل أبسط مقومات الوجود الانساني، لذلك نصت عليه مختلف الشرائع السماوية والوضعية، يرتبط هذا الحق بسائر حقوق الانسان الجسدية والنفسية، فلا يحق للسلطة السياسية بجميع سلطاتها ومؤسساتها أن تقوم بأية عوائق تحول دون ممارسة حريات الافراد وأمنهم الشخصي أو التعرض لها بأي شكل من الأشكال، أو ان تُقدم على اجراءات تعسفية ضد ممارستهم لحقوقهم وحرياتهم، لذلك عليها أن تٌؤمن للافراد الظروف الملائمة لممارسة حرياتهم كما يرغبون، وفقاً للحدود والضوابط المنظمة لممارسة الحقوق والحريات العامة التي تصوغها التشريعات، فيكون الأفراد بذلك ملتزمين بتنظيم حرياتهم مع حريات الآخرين. لا يقتصر الحق في الحرية والأمان الشخصي على عدم المساس به من قِبل السلطة السياسية، وانما يتطلب ضمانة التزامها بمنع حدوث الاعتداء على الحق في الحرية والأمان الشخصي. Other rights are preceded by the right to personal freedom and security. It is a condition for the preservation of other public freedoms, as well as one of the most fundamental elements of Human existence. As a result, it is stipulated by numerous empirical and divine legislations, that this right is related to all human physical and psychological rights. Thus, the political body, with all its powers and institutions, is not authorized to erect any obstacles that prohibit individuals from practicing their personal freedoms and security or to be subject them in any way, or to take unconstitutional steps against their exercise of their rights and freedoms. As a result, it must provide adequate requirements for individuals to exercise their freedoms as they desire, in compliance with the restrictions and controls regulating the exercise of public rights and freedoms formulated by law, so individuals are obliged to coordinate their liberties alongside the liberties of others. The right to liberty and personal security is not limited to not being infringed upon by the political authorities, but rather includes a promise of its commitment to preventing an infringement on the right to personal freedom and security.
