رخص الاستيراد كآلية لضبط قطاع التجارة الخارجية في القانون الجزائري

Résumé: سعى المشرع الجزائري لتكريس نظام رخص الاستيراد ضمن المنظومة القانونية الوطنية نتيجة للاختلالات والأزمات التي مست قطاع التجارة الخارجية، لذلك فإبراز دور رخص الاستيراد في إعادة ضبط وتأطير قطاع التجارة الخارجية أمر ضروري، من خلال التعرض لمضمونها والتميز بين أنواعها المختلفة وتحديد الآثار الناتجة عنها تبعا للأهداف المسطرة، وفقا لذلك فان الجهود والآليات المتخذة من قبل المشرع الجزائري في تنظيم هكذا رخص لم تأت بنتيجة ايجابية، اذ لا زالت دون المبتغى نتيجة للتحديات القانونية والعملية التي واجهت إعمالها وهو ما دفع بالمشرع إلى تبني إجراءات جديدة لتنظيمها بهدف تحسين وتفعيل العمل بها. The Algerian legislator sought to enshrine the system of import licenses within the national legal framework in response to disruptions and crises affecting the foreign trade sector. Therefore, emphasizing the role of import licenses in the reorganization and framing of the foreign trade sector is crucial. This involves examining their content, distinguishing between different categories, and determining the consequences arising from them based on the outlined objectives. However, the efforts and mechanisms adopted by the legislator to regulate such licenses have not yet yielded positive results. They still fall short of expectations due to legal and operational challenges faced in their implementation. This prompted the legislator to adopt new measures to regulate them with the aim of improving and activating their effectiveness.
