مكافحة جرائم المخدرات في ظل القانون 18-04 المتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع الاستعمال والاتجار غير المشروعين

Résumé: ملخص: تعد جرائم المخدرات آفة عالمية ذات آثار وخيمة تهدد استقرار المجتمعات ومصالح الناس وحياتهم، خاصة في ظل التطور التكنولوجي الذي يشهده العالم والذي كان له الأثر الكبير في تطور هذه الجرائم وتنظيمها عبر شبكات دولية، ولم تسلم الجزائر من هذه الآفة بل زادت حدتها في السنوات الأخيرة وغزت مختلف فئات المجتمع، الأمر الذي فرض على المشرع الجزائري مكافحتها من خلال تبني سياسة عقابية ضمن القانون 04-18 المتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع الاستعمال والاتجار غير المشروعين بها، حيث اتسمت هذه السياسة بالردع من خلال تضمينها مجموعة من العقوبات التي تراوحت بين التشديد والتخفيف وذلك حسب خطورتها، ولم يكتفي المشرع الجزائري عند هذا الحد بل انتهج من خلال هذا القانون سياسة وقائية تتضمن تدابير أمنية كفيلة بالحماية والوقاية من جرائم المخدرات ومنع وقوعها في آن واحد . Abstract: Drug crimes are considered a global scourage with hurtful effects that threaten the stability of societies and the interests of people and their lives, especially in light of technological development which witnessed by the world, which had a great impact on the development of these crimes through international networks. Algeria was not spared from this scourge, but rather it increased in recent years and invaded all segments of society. Which the Algerian legislator combated by adopting a punitive policy whithin law 18-04 related to the prevention of psychotropic substance and the suppression of illicit use and trafficking in them .This policy was characterized by deterrence through .It included a set of penalties that ranged between aggravation and mitigation، according to its seriousness .The Algerian legislator was not satisfied whith this، but rather adopted through this law a policy and a few that include security measures that guarante the protection and prevention of drug crimes and prevent their occurrence at the same time .
