Résumé: يعد موضوع المسؤولية القانونية للدولة كشخص معنوي عن الجرائم البيئية الدولية من الموضوعات القانونية الهامة التي تستحق البحث والدراسة، على اعتبار أن موضوع المسؤولية القانونية لمرتكبي تلك الجرائم في شقها الجنائي يعتبر بمثابة أساس من الأسس التي تقوم عليها الحماية القانونية الموضوعية ذات الطابع الدولي الجنائي، فلا جريمة بيئية دولية دون مسؤولية قانونية، وهذه المسؤولية تقوم في جانب منها ضد الدولة مرتكبة الجرائم بتوجيه منها أو لصالحها، وتأسيسا على ما تقدم واتساقا مع سوابق المحاكمات الدولية عن جرائم الحرب وما استقر عليه المجتمع الدولي في النظام الأساسي للمحكمة الجنائية الدولية، والتي نسلم من خلالها بأن المسؤولية عن تلك الجرائم هي مسؤولية الفرد، فإننا نهدف من وراء هذه المساهمة العلمية إلى إبراز الجوانب الخاصة بالمسؤولية القانونية للدولة كشخص معنوي عن تلك الجرائم في نطاق القانون الدولي الجنائي. The question of the legal responsibility of the State as a legal entity for international environmental crimes is one of the important legal questions that deserve research and study, since the question of the legal responsibility of the perpetrators of these crimes in its criminal aspect is considered one of the foundations on which rests objective legal protection of an international criminal nature, There is no international environmental crime without legal responsibility, and this responsibility rests in part on the State committing crimes at its direction or for its benefit, and on the basis of the above and in accordance with the precedents of international war crimes trials and what the international community has agreed to, in the statute of the International Criminal Court, through which we recognize that responsibility for these crimes is the responsibility of the individual, and we aim behind this scientific contribution to highlight aspects of the legal responsibility of the State as a moral person for these crimes under international criminal law.
