دور القواعد الفقهية في ترشيد الاجتهاد النوازلي المعاصر-نوازل وباء كورونا أنموذجا

Résumé: ملخص: إن من أهم علوم الفقه الإسلامي التي لا يُستغنى عنها في بحث ودراسة النوازل المعاصرة وتقرير أحكامها الشرعية: علم القواعد الفقهية، ولذا جاء هذا المقال لیسلط الضوء على دور القواعد الفقهية في ضبط وتوجيه الاجتهاد التنزيلي المعاصر، من خلال إبراز أثرها في استنباط أحكام نوازل فيروس كورونا؛ وقد اشتمل المقال على مبحثين، خصص (المبحث الأول) لبيان أهمية القواعد الفقهية ودورها في استنباط أحكام النوازل المعاصرة، وأما (المبحث الثاني) فقد عرض فيه الباحث القواعد الفقهية ذات الصلة بنوازل وباء فيروس كورونا وبعض تطبيقاتها الفقهية؛ وخلص البحث إلى إبراز أهمية القواعد الفقهية في التأصيل الشرعي لنوازل وباء كورونا، ودورها الفاعل في ترشيد الاجتهاد الفقهي المعاصر. Abstract: The science of jurisprudential rules is One of the most important sciences of Islamic jurisprudence that cannot be indispensable in studying the New Jurisprudential Cases and determining their Provisions. Therefore, this article came to shed light on the role of jurisprudential rules in the rationalization of contemporary Jurisprudence, by highlighting its impact on Inference Legal Rulings of the Issues of the Corona epidemic. The article is divided into two parts, the first part was devoted to explaining the importance of jurisprudential rules and their role in Inference the provisions of Contemporary Jurisprudence Calamities, and as for the (second part), the researcher presented the jurisprudential rules related to the calamities of the Corona virus epidemic And some of its jurisprudential applications; The research concluded with highlighting the importance of jurisprudential rules in details for jurisprudence of coronavirus pendamic, and its effective role in Contemporary Jurisprudence rationalization.
