حقوق المتقاضين الإجرائية ودورها في تحقيق أهداف التنمية المستدامة في دولة الإمارات العربية المتحدة

Résumé: الملخص تتناول الدراسة حقوق المتقاضين الإجرائية ودورها في تحقيق أهداف التنمية المستدامة، كما تبين الدراسة دور التشريعات الإجرائية بما فيها التشريعات المنظمة لعملية التقاضي أمام المحاكم الإماراتية والتشريعات التي تتعلق بالوسائل البديلة لفض المنازعات في تحقيق أهداف التنمية المستدامة، وبالرغم من أن جميع التشريعات لم تربط بين نصوصها والتنمية المستدامة فيما عدا قانون السلطة القضائية لإمارة دبي 13/2016، إلا أن الدراسة بينت مدى الإرتباط والتوافق بين هذه التشريعات والتنمية المستدامة وأهدافها، حيث تضمنت حقوقًا إجرائية للمتقاضين تؤكد على تحقيق أهداف التنمية المستدامة. ولا توجد في الحقيقة دراسات تناولت هذا الموضوع لذلك اعتمدنا على التحليل الشخصي للنصوص الإجرائية وربطها مع ما جاء من أهداف للتنمية المستدامة في الأجندة العالمية 2030 والتي صادقت عليها دولة الإمارات العربية المتحدة عام 2015م. وخرجت الدراسة بتوصية للمشرع الإماراتي بضرورة تضمين التشريعات الإجرائية بأهداف لتحقيق التنمية المستدامة وربط النصوص بما يتلائم وتحقيق التنمية المستدامة شأنها في ذلك شأن قانون السلطة القضائية لإمارة دبي 13/2016. Abstract: This study focuses on the procedural rights of litigants and their role in achieving sustainable development goals. It also explains the role of the procedural legislations, including the legislations regulating the litigation process before UAE courts and the legislations related to the alternative methods of dispute resolution, in achieving sustainable development goals. Although none of these legislations covers sustainable development in its texts, except for the Dubai Judicial Authority Law No.13 of 2016, this study shows how these legislations are linked and compatible with the sustainable development goals, because these legislations include procedural rights for litigants that emphasis the importance of achieving the sustainable development goals. In fact, there are no studies dealt with this subject before, so we relied on the personal analysis of the procedural texts and linked them with the sustainable development goals set out in the Global Agenda 2030, which were ratified by the United Arab Emirates in 2015. The study concluded that the procedural legislations included procedural rights that achieve the goals of sustainable development in relation to eradicating poverty, achieving economic growth and gender equality, and finally achieving the justice that the UAE judiciary aims to.The study also came out with a recommendation to the UAE legislator to include the sustainable development goals in its procedural legislations and to amend the legislation texts in such a manner that is consistent with achieving sustainable development goals, as is the case with Dubai Judicial Authority Law No. 13 of 2016.
