تقييم تجربة الوكالة الوطنية لتحسين السكن وتطويره- وكالة عدل- في تسيير وإدارة بنايات البيع بالإيجار

Résumé: يعد الحق في السكن من الحقوق الاساسية التي كرسها الدستور الجزائري، وعملت كل الحكومات الجزائرية المتعاقبة على تحقيقه وذلك بإيجاد عدة صيغ سكنية تتلاءم مع كل فئات المجتمع ومن أهم الصيغ السكنية التي لاقت رواجا لدى فئات المجتمع البيع بالإيجار، الذي تقوم بإنجازه وتوزيع سكناته المؤسسة العمومية المعروفة بالوكالة الوطنية لتحسين السكن وتطويره" وكالة عدل" واعتمدت هذه الأخيرة على نظام خاص(علاقة إيجارية) لإدارة وتسيير بنايات البيع بالإيجار، مختلف تماما عما هو الموجود في الأنظمة المطبقة في باقي البنايات ذات الطابع السكني الأخرى المنجزة في إطار الترقية العقارية. غير أنه عند تطبيقه نتج عنه عدة نقائص وسلبيات، خاصة من الناحية العملية والقانونية، فكان لزاما إلقاء الضوء على أساس هذا النظام المتميز ومعرفة مختلف الاشكالات القانونية التي يثيرها عند تطبيقه ثم اقتراح الحلول المناسبة. The right to housing is one of the basic rights enshrined in the Algerian Constitution, and all successive Algerian governments have worked to Apply it by creating several housing formulas that suit all segments of society. And the the most important housing formulas is « rent in sale », which is carried out and distributed by a public institution known as « the National Agency for Housing Improvement and Development » "Adl Agency". This agency adopted a special system (rental relationship) to manage and operate rent in sale buildings, completely different from what is found in the systems applied in other residential buildings completed within the framework of real estate development. However, it application shows several shortcomings, especially from the practical and legal point of view, so it was necessary to shed light on the basis of this distinguished system and knows the various legal problems, then to propose the appropriate solutions.
