فقه الموازنات ومدى تطبيقه على سكنات الوكالة الوطنية لتحسين السكن وتطويره - ما يسمى بسكنات عدل-

Résumé: الملخص: تناول البحث بالدراسة والتحليل فقه الموازنات, أو فن المقارنة والمعادلة والترجيح بين المصالح والمفاسد المتعارضة والمتزاحمة في الأمر الواحد, مع تعذر الجمع بينها, معرفا به, ومستدلا عليه, ومبينا علاقته بفقه الواقع وما يلتبس بالحادثة من قرائن وأمارات, وبفقه المآل والنتائج المستقبلية, وبفقه الأولويات ورتب المصالح والمفاسد. ثم بيّن مسألة سكنات الوكالة الوطنية لتحسين السكن وتطويره التي يشتريها المواطن في إطار البيع بالإيجار المنتهي بالتمليك مصورا لها تصويرا كاملا وذلك بذكر المراسيم والقرارات القانونية التي تحكم العقد الذي يربط بين المواطن والوكالة, وتكييف العلماء له, والذين ذهبوا فيه مذاهب شتى, فمنهم من اعتبره بيعا بالإيجار منتهيا بالتمليك, ومنهم من اعتبره عقد استصناع, ومنهم من عدّه بيعا بالتقسيط معلقا على شرط, وبناء على اختلافهم في تكييف هذه السكنات اختلفوا في حكمها الشرعي. وفي الأخير بيّن مدى تحاكم الفقهاء واستنادهم إلى فقه الموازنات والترجيح بين المصالح والمفاسد حين إصدار فتاويهم في شأن مسألة سكنات الوكالة الوطنية لتحسين السكن وتطويره التي يشتريها المواطن في إطار البيع بالإيجار المنتهي بالتمليك. Abstract: this research studied and analyzed The jurisprudence of balancing, or the art of balancing, equivalence and comparing between conflicting interests and evils in a topic, that couldn't be combined, defining it, proving it and showing it′s relation to jurisprudence of reality and the confusion that can relate to it and the jurisprudence of fate and future results and the priorities and the arrangement of interests and evils. Then, the study shows the topic of habitations of the national agency of improving and developing habitation that the citizens buy them in the form of sale on rent that ends by ownership, mentioning the legal decrees and decisions that control the contract between the citizen and the agency. And how religions scholars conditioning it. Some of them consider it as a sale on rent end to ownership, some regard it as a contract of istisna, others think that it is a sale by installment. So that, because of this disagreement in conditioning this habitation. They disagree about it′s Islamic rule. By the end, this study shows that religions scholars based on jurisprudence of balancing between interests and evils when they issued their the fatwa.
