مفهوم الاستمداد الأصولي، عرض وتأصيل

Résumé: يعد الاستمداد في العلوم من أهم ما يحدد مصادرها ويبين حقائقها، وجاءت هذه الدراسة مبينة لمفهوم الاستمداد الأصولي بأنواعه، كاشفة عن مصادر الاستمداد في علم أصول الفقه، ومبينة لأسبابه وضوابطه، وموضحة لمميزات الاستمداد وعيوبه في محاولة لتأصيل هذا المفهوم المهم في علم أصول الفقه. واعتمد البحث في تأصيله لمفهوم الاستمداد الأصولي على المنهج الوصفي التحليلي؛ وذلك بوصف الاستمداد الأصولي وتحديد أنواعه، وتحليل هذه الأنواع وتوزيعها على فروع البحث؛ لتحقيق الأهداف التي من أهمها: تغطية الجانب التأصيلي لمصطلح الاستمداد الأصولي، وأن الالتزام بالضوابط الاستمدادية يؤدي إلى الاستفادة القصوى من علم الأصول. Abstract: Derivation in the sciences is one of the most important things that identify its sources and show its facts. This study came to explain the concept of fundamentalist borrowing of all kinds, revealing the sources of derivation in the science of jurisprudence, explaining its causes and controls, and clarifying the advantages and disadvantages of derivation in an attempt to root this critical concept in the science of jurisprudence. The research relied on the descriptive-analytical approach to rooting the concept of fundamentalist derivation. By describing fundamental derivation and identifying its types, analyzing these types and distributing them to research branches; To achieve the goals, the most important of which are: Covering the fundamental aspect of the term fundamentalist derivation, which resulted in drawing an integrated picture for those wishing to become familiar with this important fundamentalist term. And that adherence to derivation controls leads to the maximum benefit from the Fundamentals science.
