التدخل الإنساني وحماية حقوق الإنسان

Résumé: ملخص: تتضمن هذه الورقة البحثية الحديث عن التدخل الإنساني، والذي يعتبر واحد من بين الأفكار او الطرق التي لجأ إليها المجتمع الدولي خاصة في السنوات الأخيرة، من أجل اعتمادها كآلية لحماية حقوق الإنسان، حيث أصبح التدخل الإنساني أكثر استعمالا عقب الحرب الباردة نظرا للتغيرات التي عرفها النظام الدولي وقيام الأحادية القطبية، وتفشي ظاهرة النزاعات، ما دفع بالأمم المتحدة على اعتماد التدخل الإنساني خاصة من طرف مجلس الأمن، الذي اعتمده في العديد من النزاعات مثل النزاع في العراق، إلا ان هذه الاستثناء الوارد عبى مبدا عمد التدخل في الشؤون الداخلية للدول، بالرغم من انه جاء بهدف حماية حقوق الإنسان، إلا أن تغيير الأهداف المرجوة منه جعله يتغير من نعمة على مدنيي الدول المنتهكة فيها حقوق الإنسان على نقمة بسبب ظهور عدة صور للتدخل في الشؤون الداخلية للدول تحت مسمى التدخل الإنساني من أجل حماية حقوق الإنسان. This research paper includes talk about humanitarian intervention, which is the method that the international community has resorted to, especially in recent years, in order to adopt it as a mechanism for the protection of human rights, as the humanitarian intervention became more used after the cold war due to the changes in the international system, and the spread of the phenomenon of conflict, which prompted the united nations to adopt humanitarian intervention, especially by the security council, which adopted it in many conflict such as the conflict in Iraq, but this exception to the principle non-interference in the internal affairs of countries, although it was aimed at protecting human rights, but changing the desired objectives made it increase the suffering of civilians in the countries in conflict, because of the emergence of several forms of interference in the internal affairs of countries under the name of humanitarian intervention in order to protect human rights.
