جرائم الحرب المرتكبة في حق الأطفال وفقا للنظام الأساسي لمحكمة روما الجنائية الدولية War Crimes Against Children According The Rome Statute Of The International Criminal Court

Résumé: الأطفال هم الأكثر عرضة للانتهاكات التي تعرفها النزاعات المسلحة، فالأمر لم يتوقف عند عدم حمايتهم وعدم التعرض لحقوقهم، بل وصل إلى إشراكهم في النزاعات من قبل الأطراف المتنازعة، وهذا يعد سلوكا مخالفا للقوانين الدولية. لذا عدّ النظام الأساسي للمحكمة الجنائية الدولية لروما في مادته08 تجنيد الأطفال من قبيل جرائم الحرب المستوجبة للمسؤولية والعقاب. كما عددت ذات المادة الانتهاكات الماسة بالأطفال الأسرى واعتبرتها هي الأخرى جرائم حرب. بناء على ذلك، ولأجل دراسة موضوع جرائم الحرب المرتكبة في حق الأطفال وفقا لنظام محكمة روما الأساسي، قسمنا البحث إلى مبحثين، تناولنا في المبحث الأول: جريمة تجنيد الأطفال واستغلالهم لهدف حربي. وفي المبحث الثاني: الانتهاكات الماسة بحقوق الأطفال الأسرى. وختمنا البحث بجملة من النتائج والاقتراحات. Children are risky to a lot of a violations during the armed conflict, so it came to be involved in because of recruitment by parties to the conflict , This constitutes conduct contrary to international law. So the article08 of the statute of international criminal of Rome has counted that work is a war crime requires international responsability and punishment.The Same article Considered the violations against the child prisoners as war crime. based on that , we stutied this subject into two sections. *Section1 :the crime of recruitment and exploitation of children for a war objective. *Section2 :violations of the rights of child prisoners. Finally we concluded our study into a set of results and propositions.
