نظام تعويض الضحايا أمام القضاء الجنائي الدولي

Résumé: الملخص: إلى جانب اختصاص القضاء الجنائي الدولي بمتابعة مرتكبي الجرائم الدولية الأشد خطورة، سواء كانت جرائم حرب، أو جرائم ضد الإنسانية أو جرائم ضد السلام، وغيرها، فإن ذات القضاء يضطلع كذلك بتعويض كافة الأشخاص المجني عليهم أو ما يصطلح عليهم" بالضحايا"، عن كافة الانتهاكات الخطيرة التي لحقت هؤلاء. بيد أن نظام التعويض -بالنظر إلى أهميته- نجده يختلف بحسب الجريمة الدولية المرتكبة، وجسامة الضرر الذي لحق الضحية، ناهيك عن تباين المحاكم الجنائية في تقدير التعويض وتقريره، وإن كان يظهر بطريقة جد محتشمة في نطاق النظم الأساسية للمحاكم الجنائية الدولية الخاصة والمختلطة، إلا أن النظام الأساسي للمحكمة الجنائية الدولية قد أولى اهتماما كبيرا بتعويض بضحايا الجرائم الدولية عن طريق الصندوق الإستئماني. Abstract: International criminal justice is not only competent to prosecute the perpetrators of the most serious international crimes, whether war crimes, crimes against humanity, crimes against peace and so on, but also to compensate all the victims for all the serious violations that have been committed against them. Given its importance, the compensation system varies according to the international crime committed and the extent of the domage caused to the victim, in addition to the discrepancy when assessing and determinating compensation by the criminal courts. The Statute of the International Criminal Court has paid considerable attention to compensation for victims of international crimes through the Trust Fund, unlike the statutes of the special and mixed international criminal courts where this system has not been widely implemented.
