دراسة قانونية حول صلاحية المنظمات الحكومية وغير الحكومية بمكافحة جرائم الفساد الجزائرية

Résumé: تهدف هذه الدراسة لإبراز مدى اختصاص المنظمات الدولية الحكومية ومنظمات المجتمع المدني وغيرها من المنظمات الدولية غير الحكومية بمكافحة جرائم الفساد الجزائرية. وقد خلصت إلى ثلاثة نتائج، تمثلت النتيجة الأولى منها في عدم اختصاص منظمة الأمم المتحدة، منظمة التعاون والتنمية الاقتصادية، مجموعة العمل المالي الدولي، منظمة التجارة العالمية، منظمة الشفافية الدولية بمكافحة جرائم الفساد الجزائرية. أما النتيجة الثانية فتمثلت في اختصاص المنظمة الدولية للشرطة الجنائية، مجموعة البنك الدولي، صندوق النقد الدولي بمكافحة هذه الجرائم، نتيجة انضمام الجزائر للاتفاقيات المنشئة لهذه المنظمات من جهة، وتعاونها مع الجزائر من جهة أخرى. كما تمثلت النتيجة الثالثة في اختصاص الجمعيات المدنية، النقابات العمالية والمهنية، وسائل الإعلام المكتوبة أو السمعية البصرية، الأحزاب السياسية في التحسيس بمخاطر الفساد، أو مواجهة المفسدين أمام القضاء. This study aims to highlight the competence extent of intergovernmental organizations, civil society organizations and other international non-governmental organizations to combat Algerian corruption crimes. It concluded three results; the first one was the competence lack of the United Nations Organization, Economic Cooperation and Development Organization, International Financial Action Task Force, World Trade Organization and International Transparency Organization to combat Algerian corruption crimes. The second result was the competence of the International Criminal Police Organization (Interpol), the World Bank Group and the International Monetary Fund to combat these crimes, as a result of Algeria's accession to the agreements establishing these organizations on the one hand, and its cooperation with Algeria on the other hand. The third result was the competence of civil societies, trade and professional unions, written or audiovisual media, and political parties to raise awareness of the corruption dangers, or to confront spoilers before the judiciary.
