المسؤولية الجزائية للشخص المعنوي عن الجرائم الانتخابية

Résumé: ملخص: يعد موضوع الجرائم الانتخابية من بين أحد أهم المواضيع في الجزائر على المستوى السياسي و القانوني ،و قد سعى المشرع الى حماية العملية الانتخابية عن طريق العديد من الآليات و الضمانات، بالإضافة الى تجريمه للأفعال التي قد تشكل مساساً بنزاهتها و شفافيتها ، و تهدف هذه الدراسة الى معرفة ما اذا كان المشرع الجزائري يسأل الشخص المعنوي جزائيا عن ارتكابه لجرائم انتخابية ،و ما الدور الذي تلعبه هذه المساءلة في حماية العملية الانتخابية ، خاصة أنه لا أحد يستطيع أن ينكر دور الأشخاص المعنوية في الحياة السياسية عامة و في العملية الانتخابية خاصة،لاسيما الأحزاب السياسية و الجمعيات و وسائل الأعلام ،و استعنا للاجابة على هذه الاشكالية بالمنهج الوصفي و التحليلي اضافة للمنهج المقارن، و توصلنا من خلال هذه الدراسة الى أن موقف المشرع الجزائري من المسؤولية الجزائية للشخص المعنوي عن الجرائم الانتخابية يشوبه نوع من الغموض و التردد، الأمر الذي لا يعتبر في مصلحة العملية الانتخابية. الكلمات المفتاحية: الجرائم الانتخابية، المسؤولية الجزائية، الشخص المعنوي،الحزب السياسي، العقوبة Abstract: On of the main Algerian issues at the political and legal level is the electoral crimes, as the legislation intended to protect the electoral process by many mechanisms and guarantees and to prohibit the acts that may include a prejudice to the integrity and transparency thereof ,This is intended to determine whether the Algerian legislation deems the legal person criminally responsible for committing electoral crimes, and the role of this responsibility in protecting the electoral process, as the role of the legal persons cannot be denied in politics in general and the electoral process particularly, such as the political parties ,associations and the media ,in response to this issue, we have used the descriptive ,analytical and comparative approach ,By this Thesis, we concluded that the Algerian legislation positon regarding the criminal responsibility of the legal person for electoral crimes is ambiguous and uncertain ,which negatively affect the electoral process.
