Résumé: ملخص: إنّ عقوبة الحبس أدّت إلى ظهور الكثير من السلبيات على المحكومين بها مثل: اكتظاظ السجون، وارتفاع نسبة العود إلى الجريمة ممّا أدى إلى التفكير في عقوبات تتجنب هذه السلبيات؛ فظهرت عقوبات بديلة عن الحبس منها "عقوبة العمل للنفع العام"، وقد جاءت هذه الدراسة " موقف الفقه الإسلامي من عقوبة العمل للنفع العام في ظل قانون العقوبات الجزائري" لتجيب عن الاشكال الرئيسي: ما هو موقف الفقه الإسلامي من عقوبة العمل للنفع العام في ظل قانون العقوبات الجزائري ؟ وممّا خلصت إليه: أنّ عقوبة العمل للنفع العام جائزة وتدخل في باب التعزير الخاضع لاجتهاد الحاكم إذا لم يحكم بها القاضي فيما هو مخالف لمبادئ ونصوص الشريعة الإسلامية، وأنّ عقوبة العمل للنفع العام لها مزايا كثيرة أهمها المرونة في تطبيقها بما يلائم حال الجاني لكن يوجد فيها بعض المساوىء كاشتراط كون المحكوم بها غير مسبوق قضائيا، وقصرها على المحكومين مدة قصيرة محددة بعام فأقل. Abstract: The penalty of imprisonment has many negatives for the convicts, so the jurists thought of alternative punishments, including the “penalty for working in the public interest. " The position of Islamic jurisprudence on the punishment of working in the public interest under the Algerian Penal Code" To answer the main question: What is the position of Islamic jurisprudence on the punishment of working for the public interest under the Algerian Penal Code?And the most important thing I concluded: that the penalty for working for the public benefit is permissible, and is subject to the judge’s discretion, and this is if it does not violate the principles and texts of Islamic Sharia And that the penalty for working for the public benefit has many advantages, the most important of which is flexibility in applying it in proportion to the condition of the offender, but there are some defects in it, such as the requirement that the convict be punished. It must be without a judicial precedent, and it is limited to those sentenced to a short period of one year or less.
