المحل بين العقد والالتزام - دراسة مقارنة -

Résumé: يعد المحل من المسائل الشائكة في الفقه التي لم يجد لها حلا، وعلى الرغم مما بذله شراح نظرية الالتزامات من جهود في هذا السبيل، ما يزال أرضا خصبة للبحث، إذ يكمن الاختلاف في المحل حول الكائن القانوني الذي ينتمي إليه، هل العقد أو الالتزام أو كلاهما معا، أو إلى التصرف القانوني. وكل هذه الخلافات نتجت عنها عدة مذاهب واتجاهات فقهية، وقد انتهى بنا البحث إلى القول بأن المحل هو ركن في الالتزام كما جاء به التشريع المصري والجزائري، أما التشريع الفرنسي فقد تاه بينهما وكان ذلك سببا في حذف المحل وجعله عنصرا من عناصر مضمون العقد. The locus is one of the thorny issues in jurisprudence that has not been resolved, and despite the efforts made by the explainers of the theory of obligations in this way, it is still fertile ground for research, as the difference lies in the locus about the legal object to which it belongs, is the contract or the obligation or both together, or to legal disposition. And all these differences resulted in several doctrines and jurisprudential trends, and the research ended with us saying that the object is a pillar of commitment as stated by the Egyptian and Algerian legislation, while the French legislation lost between them, and that was a reason for deleting the object and making it an element of the content of the contract.
