الشروط القانونية لاستخدام البصمة الوراثية في التشريع الجزائي
Résumé: إن البصمة الوراثية تعتبر من أهم التقنيات العلمية الحديثة التي تستخدم في الاثبات الجزائي وفي البحث عن هوية الأشخاص والتصدي لمختلف الجرائم، وهي تعد دليلا مهما في ذلك، وقد وضع المشرع الجزائري أحكاما خاصة بها في القانون رقم 16-03 الذي تضمن شروط وإجراءات وكيفيات استخدامها من طرف مختلف الجهات القضائية، وضباط الشرطة القضائية الكفيلة بتطبيقها، والأشخاص، والجرائم المعنية بها.Genetic fingerprinting (DNA fingerprinting) is considered one of the most important modern scientific techniques used in the issues of criminal evidence, of searching for the identity of persons and of dealing with various crimes, and thus, is deemed an important guide to be utilized in penal cases. In this respect, the Algerian legislator has enacted specific provisions for DNA fingerprinting through Law No. 16-03,which provides for conditions, procedures and clauses of its use by different judicial bodies and officers of Judiciary Police, legally entitled to enforce it, as well as persons and crimes relevant thereto.
