Résumé: تتناول هذه الدراسة بيان دور الاجتهادات القضائية في حفظ حقوق المرأة المطلقة، فغني عن البيان أن المرأة المطلقة تكون لها حقوق مكتسبة بمجرد صدور حكم الطلاق سواء لفظا أو حكما، وإذا كان القضاء مهمته في المقام الأول تفعل النصوص التشريعية ذات الصلة بالطلاق وأثاره، إلا أنه أيضا له دور في تكريس مبادئ قانونية هامة عند ممارسته لوظيفة الاجتهاد على مستوى الهيئة القضائية العليا في البلاد، وهو ما نود بحثه من خلال تحليلنا لمختلف الاجتهادات القضائية الخاصة بآثار الطلاق. This statement deals with the role of jurisprudence in preserving the rights of divorced women. It goes without saying that divorced women have acquired rights once the divorce ruling has been issued, whether by word or sentence. If the judiciary is primarily concerned with the legislative texts related to divorce and its effects, Has a role in the establishment of important legal principles in the exercise of the function of conscientiousness at the level of the highest judicial authority in the country, which we would like to discuss through our analysis of various jurisprudence on the effects of divorce.
