جريمة السرقة بين الأقارب بين خوصصة المتابعة و الحصانة العائلية

Résumé: ملخص: خص المشرع الجزائري جريمة السرقة بين الأقارب بأحكام خاصة وهذا باعتبارها مانعا من موانع العقاب هذا ما جاء في المادة 368 من قانون العقوبات التي تنص على أنه "لا عقوبة على السرقة " ،وإن المشرع وازن بين مصلحتين هما حماية حق الملكية والحفاظ على الترابط الاجتماعي للأسرة ورجح الثانية على الأولى، إذ منع العقاب على السرقات التي ترتكب فيما بين الأصول والفروع ولا تخول إلا الحق في التعويض المدني، كما قيد تحريك الدعوى العمومية على شكوى المضرور و هذا في السرقات الواقعة بين الأزواج و الحواشي و الأصهار لغاية الدرجة الرابعة. فهل وفق المشرع الجزائري من خلال سياسته المنتهجة في تحقيق حماية الأسرة و منعها من التفكك؟ و هل يساهم هذا القيد و المانع في تفاقم الجرائم العائلية؟. Abstract : The Algerian legislature has singled out the crime of theft among relatives by special provisions. This is as a deterrent from punishment. This is stated in Article 368 of the Penal Code, which states that "there is no punishment for theft." The legislator balances two interests: protecting property rights and maintaining the social cohesion of the family. The second is on the first. It prohibits the punishment of thefts committed between assets and branches and grants only the right to civil compensation. It also restricts the public action against the victim's complaint. This is in thefts between spouses and footnotes until the fourth degree. Does the Algerian legislator follow through his policy of achieving family protection and preventing it from disintegrating? Does this restriction contribute to the aggravation of family crimes?.
