المحكمة الجنائية الدولية وعلاقتها بالولايات المتحدة الأمريكية

Résumé: عرف القضاء الجنائي الدولي تطورا هائلا بدأ مع محاولات المحاكمة في الحرب العالمية الأولى ومحاكمات الحرب العالمية الثانية مرورا بمحاكمات يوغسلافيا ورواندا وصولا إلى المحكمة الجنائية الدولية، وقد كانت تلك المحاكم هي التجارب التاريخية الواقعية التي بدأ فيها المجتمع الدولي محاولة إيجاد اختصاص جنائي دولي لإقرار المسؤولية الجنائية الفردية للأشخاص الطبيعيين عما ارتكبوه من جرائم دولية تهز ضمير العالم. ويعد إنشاء المحكمة الجنائية الدولية كأحد أهم الآليات لمعاقبة ومتابعة هؤلاء المجرمين وعدم منحهم حصانة تقتضي بإعفائهم من المساءلة والعقاب، وهو ما سعت إليه الولايات المتحدة الأمريكية من خلال إصدار قرارات من مجلس الأمن وإبرام اتفاقيات دولية تقضي بعدم خضوع مواطنيها وأفراد قواتها المسلحة للمساءلة والمتابعة أمام المحكمة الجنائية الدولية. Abstract: The international criminal justice system has witnessed a tremendous development that started with the trial attempts in the First World War and the World War II trials, through the trials of Yugoslavia and Rwanda, and the International Criminal Court. For normal people, the international crimes they committed shake the conscience of the world. The establishment of the International Criminal Court is considered one of the most important mechanisms for punishing and following up these criminals and not granting them immunity that requires exempting them from accountability and punishment, which is what the United States of America has sought through the issuance of Security Council decisions and the conclusion of international agreements requiring that its citizens and members of its armed forces not be held accountable and followed up before the Criminel Court International.
