Résumé: تعالج هذه الورقة البحثية مسألة الأحكام الفقهية الشرعية التي كانت تفرض على أهل الذمة من النصارى داخل المجتمع المسلم في بلاد المغرب الإسلامي،وهي في نفس الوقت تكشف عن مدى احترام النصارى لهذه القوانين على اعتبار انها تقوم بتنظيم شؤون حياتهم من خلال ضمان حقوقهم وأداءواجباتهم،هذا بالإضافة إلى توضيح صورالتسامح والتعايش التي كان المسيحيون يتمتعون بها. ولاغرو في أن ذلك مثل أرقى القيم في العدالة والتعامل مع غير المسلمين داخل المجتمع الإسلامي.وفي المقابل تظهر الدراسة العقوبات المترتبة عن المخالفين ودور المحتسب في تطبيق هذه الأحكام وموقف الفقهاء منها. This research paper addresses the issue of Sharia jurisprudence rulings that were imposed on the people of the Christian community within the Muslim community in the Islamic Maghreb, and at the same time it reveals the extent to which Christians respect these laws as they regulate their affairs by ensuring their rights and performing their duties. This In addition to clarifying the forms of tolerance and coexistence that Christians enjoyed. It is not surprising that this is like the finest values in justice and dealing with non-Muslims within the Islamic community. On the other hand, the study shows the penalties resulting from violators, the role of the accountant in applying these provisions and the position of jurists regarding them.
