التنظيم القانوني لمجلس المنافسة

Résumé: يعتبر مجلس المنافسة إحدى سلطات الضبط الإقتصادي والذي نص عليه المشرع الجزائري لأول مرة سنة 1995 بموجب قانون المنافسة في ظل الإصلاحات الإقتصادية التي شهدتها الجزائر في بداية التسعينات، حيث يعد هيئة مكلفة بتسيير وتشجيع المنافسة الحرة والنزيهة في السوق لضمان المساواة بين المتنافسين الإقتصاديين وحماية المستهلكين عن طريق فرض مجموعة من القواعد والقوانين التي تهدف الى قمع التصرفات والممارسات المنافية للمنافسة، كما أن المشرع منح لمجلس المنافسة مجموعة من الخصائص من بينها التمتع بالإستقلالية المالية والإدارية والشخصية المعنوية كما منحه، المشرع جملة من الوظائف منها التنازعية وغير التنازعية (الإستشارية والتنظيمية) وذلك بهدف تمكينه من الضبط الفعال للمنافسة داخل السوق بين المتعاملين الإقتصاديين وقمع كافة التصرفات التي قد تمس بقواعد المنافسة الحرة. الكلمات المفتاحية: مجلس المنافسة، سلطة ضبط اقتصادية، الصلاحيات التنازعية و غير التنازعية، الطعن في قرارات المجلس. Abstract: The Competition Council is one of the economic regulatory authorities established by Algerian legislation for the first time in 1995 under the Competition Law, in the context of the economic reforms Algeria witnessed in the early 1990s. It serves as a body responsible for managing and promoting free and fair competition in the market to ensure equality among economic competitors and protect consumers by imposing a set of rules and laws aimed at suppressing anti-competitive behaviors and practices. The legislator has granted the Competition Council a number of characteristics, including financial and administrative independence and legal personality. It has also been endowed by the legislator with a range of functions, both contentious and non-contentious (consultative and regulatory), with the aim of enabling it to effectively regulate competition within the market among economic operators and suppress all behaviors that may affect the principles of free competition.
