شغور منصب رئيس الجمهورية وآثاره في النظام الجزائري

Résumé: إن عهدة رئيس الجمهورية محددة دستوريا، لكن قد يصيبها في بعض الحالات ما يعرف بحالات شغور منصب رئيس الجمهورية، وقد تكون هذه حالات شغور بسبب مانع مؤقت أو دائم، بالإضافة إلى حالات أخرى لانقضاء العهدة الرئاسية مثل الخيانة العظمى والإقالة، وعند حدوث هذه الحالات من الشغور، تجب إجراءات من أجل إعلان شغور منصب رئيس الجمهورية ومنها اجتماع البرلمان بغرفتيه، وذلك من أجل المعالجة القانونية لحالات شغور منصب رئيس الجمهورية بتولي رئيس مجلس الأمة رئاسة الدولة، وإلا تولي رئيس المجلس الدستوري رئاسة الدولة. الكلمات المفتاحية: رئيس الجمهورية – حالة الشغور – منصب – الإجراءات – المعالجة القانونية Summary : The term of office of the President of the Republic is constitutionally defined, but in some cases it may be affected by what is known as cases of vacancy in the position of the President of the Republic, and these may be cases of vacancy due to a temporary or permanent impediment, in addition to other cases of expiration of the presidential term such as high treason and dismissal, and when these cases of vacancy occur Procedures are required to declare the vacancy of the position of the President of the Republic, including the meeting of Parliament in its two chambers, in order to legally address cases of vacancy in the position of the President of the Republic by assuming the Presidency of the State, otherwise the President of the Constitutional Council assumes the Presidency of the State.
