شرح الحديث النبوي بين المحدثين والفقهاء

Résumé: ملخص اهتم علماء المسلمين بشرح الحديث النبوي، وبينوا أحكامه وما فيه من فوائد، باعتباره أحد الفروع المهمة في علم الحديث، وقد تعددت هذه الشروح بين المحدثين والفقهاء، وكلٌّ يعالج الحديث ويجليه من وجهة فنه وتخصصه ويبذل جهدا لإثارته وبيان هدفه، فالمحدث يطغى عليه جانب الإسناد والمتن، والفقيه عادة ما يهتم بإثراء متن الحديث باستنباطات فقهية عميقة. ومن خلال هذا البحث سوف نسعى لبيان دور المحدثين والفقهاء في شرح الحديث، وما هو الفرق بين الشرحين؟ وما ينفرد كل فريق عن الآخر؟ وأين يتكاملان؟ وذلك باعتبار أن المحدث ليس ملزما بشرح الحديث شرحا عميقا، كما أنه لا يعذر الفقيه في أن يتساهل مع ثبوت الحديث والتأكد من صحته، كل هذه الإشكالات ستظهر وتتضح من خلال هذا البحث. الكلمات المفتاحية: الحديث النبوي، الشرح، الفقه. ABSTRACT: Muslim scholars had been interested in explaining the Hadith, and indicating it's provisions and learnings, as one of the important fields of the Hadith sciences. Those explanations diversed from Hadith to Fiqh scholars, in the way of treating Hadith and presenting its meanings, through the specialised point of view of each scholar. They both made their best to clarify the meanings and goals of the Hadith, but the Hadith scholars are predominated by the subject of support and board (narrators and texts), while the Fiqh scholars are overshadowed by enriching the deep doctrinal derivings from the text of the Hadith. Through this research, we tried to discuss the role of both Hadith and Fiqh scholars in explaining the Hadith, and what are the differences between them ? What are their points of diversity and complementary ? Taking in consideration that the Hadith scholars are not obliged to deeply explain the Hadith, and the Fiqh scholars had no excuse to tolerate in proving Hadith and its trust. All those problematics will be presented and clarified in this research
