التدخل الدولي الإنساني: مفاهيم أولية.

Résumé: الملخص: يهدف البحث إلى تناول التدخل الإنساني الذي ارتبط غرضه بحماية المعرضين للخطر أو مساعدتهم وبحماية حقوق الإنسان عموما، كما يهدف لمعرفة الظروف التي جعلت منه إحـدى الدعامات الأساسية لتحقيق السلم الأمن الدوليين، رغم الجدل المثار حوله، خاصة فيما يتعلق بإمكانية التصادم بين التدخل الإنساني و مبدأ سيادة الدولـة . وقد توصلنا إلى أنّ المفهوم الحديث للتدخل الإنساني تكرس من خلال النظام العالمي الجديد، وأيضا من خلال التدخلات الإنسانية التي وقعت بعد التسعينات، والتي اتخذت طابعا جماعيا ارتبط تنفيذها من الناحية العملية بالتدخل الإنساني لمنظمة الأمم المتحدة، كما توصلنا إلى أنّ خطورة الآثار السياسية والقانونية المترتبة عن التدخل، وخاصة مع وجود مبادئ قارة في القانون الدولي العام مثل مبدأ السيادة ومبدأ عدم التدخل سمح بالتوجه نحو مسؤولية الحماية كبديل للتدخل الإنساني. Abstract: The research aims to address humanitarian intervention, whose purpose has been linked to the protection or assistance of those at risk and to the protection of human rights in general, as well as to find out the circumstances that have made it one of the main pillars for achieving international security peace, despite the controversy raised around it to this day again, especially with regard to the possibility of a clash between humanitarian intervention and the principle of state sovereignty. We have concluded that the modern concept of humanitarian intervention is enshrined through the world order, , and we have found that the seriousness of the political and legal implications of intervention, particularly with the existence of continental principles in general international law such as the principle of sovereignty and the principle of non-interference, has allowed the trend towards the responsibility of protection as an alternative to humanitarian intervention.
