حوكمة الصفقات العمومية الالكترونية في التشريع الجزائري -المرسوم الرئاسي 15/247-

Résumé: تهدف الدراسة إلى تحديد إذا ما كانت التكنولوجيات الحديثة ستساهم بفعالية في حوكمة الصفقات العمومية بالجزائر، وبالنتيجة خفض معدلات الفساد الإداري والمالي بها، وذلك من خلال تحليل المعطيات المتاحة حول هذا المجال في عدد من التقارير المختارة الوطنية والدولية. كما تم اقتراح مخطط عملي يوضح أهم الخطوات المرحلية الواجب اتخاذها لتجسيد مشروع الصفقة العمومية الإلكترونية، وكذا تم توقع أهم النتائج المترتبة عن اعتماده، وتحديد المعوقات التي تحول دون تجسيده. خلصت الدراسة إلى ضرورة رقمنة الصفقات العمومية بالإدارات العمومية الجزائرية في أقرب الآجال، والإسراع في اعتماد الإطار القانوني المنظم للصفقة العمومية الإلكترونية. This study aims to determine whether modern technologies will contribute effectively to the governance of public tenders in Algeria, and consequently reduce the administrative and financial corruption rates, by analyzing the available data in some national and international chosen reports. Also, a practical scheme has been proposed that clarifies the most important steps to be taken in the process of implementing the project of E-public tender, the results of adopting this project have been anticipated as well, and the obstacles to its realization was determined. This study concluded that it is necessary to digitize public tenders in Algerian public administrations as soon as possible and to set up the legal framework governing the electronic public procurement
