نزع الصفة المادية للصفقات العمومية على ضوء تفعيل البوابة الإلكترونية للصفقات العمومية، دراسة مقارنة مع دول المغرب العربي.

Résumé: تهدف هذه الدراسة إلي إبراز دور المشرع في نزع الصفة المادية للصفقات العمومية في الجزائر، على ضوء التعديلات التي جاء بها المشرع الجزائري لقانون الصفقات العمومية، حيث اعتمدنا في دراستنا على المنهج الوصفي التحليلي للإجابة على إشكالية الدراسة، التي ركزت على تقييم المجهودات المبذولة من طرف المشرع الجزائري في إدخال التعاملات الالكترونية في مجال الصفقات العمومية على ضوء البوابة الالكترونية للصفقات العمومية التعاقد عبر البوابة الالكترونية يوسع في مجال المنافسة، وبالتالي الحصول على عروض كثيرة في ظرف زمني قصير، عدم وجود آليات تقنية لتفعيل عمل البوابة الإلكترونية للصفقات العمومية على أرض الواقع أدى الى تأخر في تفعيلها على أرض الواقع على عكس دول المغرب العربي. This study aims to highlight the role of removing the material character of public procurement in Algeria, in light of the amendments introduced by the Algerian legislator to the law on public procurement, as we relied in our study on the descriptive analytical approach to answer The problem of the study, which focused on evaluating the efforts made by the Algerian legislator in the introduction of electronic transactions in the field of public deals in light of the electronic portal for public procurement. Contracting through the electronic portal is expanded in the field of competition, Consequently, obtaining many offers in a short period of time, the lack of technical mechanisms to activate the work of the electronic portal for public procurement on the ground led to a delay in its activation on the ground, unlike the countries of the Maghreb.
