Résumé: الزواج المبكر للأطفال زواج يكون احد أو كلا طرفيه طفلا لا يتعدى سنه 18 عشر سنة، يكون نتيجة عدة أسباب مختلفة منها ما هو ذو طبيعة اجتماعية ومنها ما هو ذو طبيعة اقتصادية ومنها ما هو ذو طبيعة سياسية، يترتب عليه بالضرورة العديد من الآثار الايجابية والسلبية. حماية للطفل تم تكريس إجراء الإذن القضائي بزواج الطفل كرخصة تجيز صحة هذا الزواج، يتمتع القاضي في إطار ممارسته لاختصاص منح الترخيص بالزواج بسلطة تقديرية واسعة في منح الإذن أو عدم منحه، مع توقيع الجزاء على المخالفين. Early marriage for children is a marriage in which one or both parties are a child who does not exceed the age of 18 years. It is the result of several different reasons: some of them are of a social nature, some others are of an economic nature, and some are of a political nature, It is a marriage that necessarily has many positive and negative effects. In order to protect the child, the judicial authorization procedure for child marriage has been established as a license authorizing the validity of this marriage. In exercising the jurisdiction of granting permission to marry, the judge has broad discretionary power to grant permission or not, with the penalty inflicted on violators.
