مظاهر الحماية الجزائية للمستهلك الالكتروني من الإشهار التجاري الالكتروني المضلل وفق أحكام القانون 18-05 المتعلق بالتجارة الالكترونية.

Résumé: لقد أولى المشرع الجزائري عناية خاصة لحماية المستهلك الإلكتروني بتكريس قواعد شفافية المعاملات التجارية الإلكترونية التي تتم بينه وبين الموردين الإلكترونيين، وهو ما يتضح من خلال أحكام القانون رقم 18-05 المؤرخ في 26 ماي 2018، المتعلق بالتجارة الإلكترونية، سعيا منه لسد الفراغ القانوني الذي كان يعتري مثل هذا النوع من المعاملات. فبالعودة إلى هذا القانون يتضح أنه قد نص على أحكام موضوعية و أخرى إجرائية متعلقة بجريمة الإشهار التجاري الإلكتروني المضلل، كما أقر عقوبات توقع على الموردين الإلكترونيين في حالة ارتكاب هذه الجريمة، لذا جاء هذا المقال من أجل البحث فيما إذا كان المشرع الجزائري قد وفق في ضمان الحماية الجزائية اللازمة للمستهلك الإلكتروني من الإشهار التجاري الإلكتروني المضلل، وذلك وفق أحكام القانون رقم 18-05 السالف الذكر. The Algerian legislator has paid special attention to the protection of the electronic consumer in dedicating the rules of transparency of electronic transactions that take place between him and electronic suppliers, which is evident in the provisions of Law No. 18-05 of May 26, 2018, related to electronic commerce, in an effort to fill the legal vacuum that was considered such a type of transactions. Back to this law, it is clear that it has stipulated substantive and procedural provisions related to the crime of misleading electronic commercial publicity, It also passed penalties for electronic suppliers in the event of committing this crime. Therefore, this article came in order to search whether the Algerian legislator has been successful in ensuring protection the electronic consumer from misleading electronic commercial publicity, in accordance with the provisions of Law No. 05-18 of the aforementioned.
