واجبات ولي الأمر عند الإمام الداودي من خلال كتابه الأموال "دراسة نظرية تطبيقية"

Résumé: إن لولي الأمر في الإسلام وظائف ومهام متعددة، يجب عليه القيام بتنفيذها على الوجه الذي يحقق الصالح العام للرعية؛ لأن هذا يكفل للدولة الوحدة والالتحام والتمسك المتين بين أفراد شعبها، ويضمن لها الاستمرارية والبقاء، وقد بينها الإمام الداودي في تضاعيف كتابه الأموال من خلال النظر والاستنباط مما بينه وأفتى به فيما يتعلق بمسائل الأموال، فكان الغرض تبيان واجبات الحاكم ولي الأمر ومهامه عند الإمام الداودي من خلال هذا الكتاب العامر المفيد سالكين بذلك منهج الاستقراء والاستنباط للوصول لهذا المبتغى والمأمل. لقد تُوصل إلى أن الإمام الداودي تعرض لمهام ولي الأمر ومسؤولياته جميعا على ما ذكره الماوردي في كتابه الأحكام السلطانية، ولكن الملاحظ على الإمام الداودي أنه ألبسها لبوس الأحكام المتعلقة بالأموال كتقدير الأعطيات وتقسيم الغنائم وأحكام الخراج والجزية والفيء وغيرها من المسائل؛ لأن ذلك هو الغالب على كتابه. The ruler in Islam has multiple functions and tasks, which he must carry out in favor of the public interest of the parish, because this guarantees the state unity, cohesion and strong adherence among its people, and ensures continuity and survival. Imam Daoudi included these functions throughout his book “funds” by looking at and drawing from what he had shown and given regarding money issues. The purpose was to show the duties and functions of the ruler as the guardian according to Imam Daoudi through this useful book, thereby adopting the method of induction and extrapolation to reach this desire and hope. It has been concluded that Imam Daoudi addressed the tasks and responsibilities of the ruler according to what Al-Mawardi said in his book “The Ordinances of Government”. It is noticeable, however, that Imam Daoudi characterized it as provisions concerning the money, such as the assessment of gifts or money, the division of the spoils, the provisions of taxes, tribute, loot, and other matters because that is the majority of his book.
