المسؤولية الإدارية للمؤسسات الإستشفائية العمومية

Résumé: تهدف هذه الدراسة إلى البحث في قواعد ونظريات المسؤولية الإدارية التي تستند بالأساس إلى الخطأ أو ما يسمى بالخطأ المؤسساتي في القانون الإداري،وتطبيقاتها في القانون الجزائري بالمقارنة مع القانون الفرنسي، والذي يعتبر من النظريات الحديثة والتي تم إعادة صياغتها والتي استعارت العديد من قواعد القانون المدني، وهي نظرية الخطأ المؤسساتي قبل أن تتبلور وتستقل بخصوصيتها ، بحيث أن مسؤولية المؤسسات الإستشفائية العمومية يكون الخطأ المنسوب إلى موظف مجهول أو معلوم، فالخطأ ينسب مباشرةً إلى المؤسسة الذي يترتب عنه الضرر ، ويترتب عنه مسؤولية الإدارة التي تتحمل عبء التعويض عنه مباشرة،ومتى كان الخطأ المؤسساتي ، تنعقد مسؤولية الإدارة. نلاحظ أن الفقه والقضاء قد اجتهدوا لتحديد ماهيته،وصوره وأن الفقه استطاع تحديد مدى الخطأ في ضبط تنظيم وإدارة المؤسسات الاستشفائية العمومية. Abstract :This study aims to investigate the rules and theories of administrative responsibility that are based mainly on error or the so-called institutional error in administrative law, and their applications in Algerian law compared to French law, which is considered one of the modern theories that have been reformulated and that borrowed many of the rules of civil law, It is the theory of institutional error before it crystallizes and is independent in its privacy, so that the responsibility of public hospital institutions is the error attributed to an unknown or known employee. Management is held responsible. We note that jurisprudence and jurisprudence have worked hard to determine what it is and its forms, and that jurisprudence was able to determine the extent of error in controlling the organization and management of public hospital institutions.
