توظيف تقنيات الذكاء الاصطناعي من طرف الممثل القانوني للشخص الاعتباري في ظل رقمنة قطاع العدالة

Résumé: الملخص: تعد مسألة تمثيل الشخص المعنوي أمام الجهات القضائية مسألة بالغة الأهمية، في ظل ممارسة الادارة العامة لوظائفها وامتيازاتها المقررة لها قانونا، ويستمد الممثل القانوني صفة التمثيل للشخص الاعتباري من القانون الذي كرس مبدأ مهم في إعفاء الدولة من التمثيل الوجوبي بمحامي وتركها مسألة اختيارية لبعض الادارات والمؤسسات العامة حسب التنظيمات واللوائح المعمول بها حسب كل قطاع، وهذا نظرا لوجود الكفاءات والاطارات القادرة على تسيير المنازعة بدلا من المحامي وهذا من شأنه ترشيد النفقات العامة، إلا أن مزاولة هذه المهمة في ظل التقنيات الحديثة لاسيما في قطاع العدالة قد تترتب عنه إشكالات لاسيما منها تشخيص القضية والتي تعرقل سير المرفق العام عمله بانتظام. summary: The issue of representing a legal person before judicial authorities is a very important issue, in light of the public administration exercising its functions and privileges legally assigned to it. The legal representative derives the status of representation for a legal person from the law, which established an important principle in exempting the state from obligatory representation by a lawyer, leaving it an optional issue for some public departments and institutions. According to the regulations and regulations in force for each sector, this is due to the presence of competencies and frameworks capable of managing the dispute instead of the lawyer, and this would rationalize public expenses. However, practicing this task in light of modern technologies, especially in the justice sector, may result in problems, especially diagnosing the case. Which hinders the regular functioning of the public facility.
