نفاذ المعاهدات الدولية في الجزائر في ظل التعديل الدستوري لسنة 2020

Résumé: ملخص: إن نفاذ المعاهدات الدولية في النظام القانوني الداخلي لأي دولة، يقتضي التقيد والقيام بالخطوات والإجراءات التي تمليها قواعد القانون الدولي العام وكذا قواعد القانون الداخلي، وفي هذا العامل المشترك يثور النقاش حول أي القواعد الأولى بالتطبيق والسمو، وما هي الإجراءات التي يعتمد عليها حتى تكون الدولة ملزمة بتنفيذ تعهداتها الدولية، لكن رغم هذا فإنّ القانون الدولي يعترف بالقواعد الجوهرية في القانون الداخلي والتي يتحدد من خلالها مدى تقيد الدولة بالتزاماتها الدولية. حيث تمثل دساتير الدول المعيار الأكثر أهمية في تقرير المكانة التي تحتلها المعاهدات الدولية في النظام القانوني الداخلي، وهي التي تحدد الإجراءات التي يلزم الدولة اتخاذها لوضع المعاهدة موضع النفاذ. Abstract: The implementation of international treaties in the internal legal system of any state requires compliance and making the steps and procedures dictated by the rules of public international law as well as domestic legal rules. In this common factor, the debate arises about which rules should be applied first and superior, and what procedures are necessary for a state to be obligated to fulfill its international commitments. Despite this, international law recognizes the fundamental rules of internal law through which the extent of a state’s compliance with its international obligations is determined. So, the constitutions of countries represent the most important criterion or standard in determining the status of international treaties within the domestic legal system, and they determine the procedures that a state must follow to implement a treaty.
