دور المحكمة الدستورية في الرقابة على دستورية المعاهدات الدولية في الجزائر وفق التعديل الدستوري المؤرخ في 30 ديسمبر 2020

Résumé: تعتبر المعاهدات الدولية من أهم الطرق والآليات القانونية التي تساهم في تنظيم التعاون الدولي بين أعضاء المجتمع الدولي في كافة الميادين والمجالات، مما يجعل موضوع الرقابة على دستورية المعاهدات الدولية ذو أهمية بالغة كونه يتعلق بحماية سمو الدستور في مواجهة هذا التطور الهائل للقانون الدولي الاتفاقي. ومن أجل ذلك وجب إتباع آلية الرقابة على دستورية المعاهدات الدولية التي تمارسها المحكمة الدستورية المنصوص عليها في التعديل الدستوري لسنة 2020 قبل المصادقة عليها رغم أن هذا الإجراء غير إلزامي، وتبيان العلاقة بين القانون الدولي والقانون الداخلي، ومكانة المعاهدات الدولية في الهرم القانوني داخل الدولة. International treaties are considered one of the most important legal methods and mechanisms that contribute to international organizing cooperation among members of the international community in all fields, which makes the issue of oversight on the constitutionality of international treaties extremely important, as it is related to the protection of the constitution’s supremacy in the face of this tremendous development of international convention law. For this reason, it is must be following the mechanism of oversight on the constitutionality of international treaties exercised by the Constitutional Court stipulated in the constitutional amendment of 2020 before ratifying it although this procedure is not mandatory, and clarifying the relationship between international law and domestic law, and the position of international treaties in the legal hierarchy within the state.
