الضوابط القانونية لنشاط التوزيع الإلكتروني في قانون المنافسة الجزائري

Résumé: لقد ساعد التوزيع الإلكتروني في تطوير الصناعات المختلفة كصناعة السيارات و المنتجات عالية التقنية، و سوق العطور و المجوهرات و غيرها من الصناعات المختلفة. و بناء على ذلك، و أمام تعايش نوعين من نشاط التوزيع: التقليدي و الإلكتروني و بالتالي فما هي الضوابط القانونية التي تضمن ممارسة نشاط التوزيع الالكتروني و حماية القائمين بهذا النشاط الاقتصادي؟ يهدف هذا المقال لبيان أهم الضوابط القانونية لممارسة نشاط التوزيع الإلكتروني في قانون المنافسة رقم 03-03 المعدّل و المتمّم، و ضمان حماية شبكة التوزيع تجاه الموزعين غير المسجّلين في السجل التجاري و سجّل الصناعات التقليدية و الحرفية، على أن تعمل السلطات العامة على تدعيم وتوضيح و تفصيل النصوص القانونية و التنظيمية المرتبطة بتنظيم النشاط الاقتصادي الالكتروني عامة و نشاط التوزيع الالكتروني خاصة . The electronic distribution has helped in the development of various industries such as the automobile industry, high-tech products, the perfume and jewelry market and other various industries. Accordingly, two types of distribution activity coexist: traditional and electronic, there for, what are the legal controls that guarantee the exercise of the activity of electronic distribution and the protection of those involved in this economic activity? This article aims to clarify the most important legal controls for practicing electronic distribution activity from the perspective of Algerian competition law n°03-03 amanded and supplemented, and to ensure the protection of the distribution network towards distributors not registered in the commercial register, and register of traditional and handcraft industries. Then the public authorities would work to support, clarify and detail the legal and regulatory texts related to the organization of electronic economic activity in general and electronic distribution activity in particular.
