قانون المنافسة و نشاط السينما

Résumé: تعزى أهمية موضوع الدراسة الى ارتباطه بموضوع أساسي يمزج بين الأهمية القانونية والإقتصادية، حيث ترتبط ممارسة أي نشاط السينما بالمنافسة، فليس من شك في أن المنافسة تعد ركنا أساسيا من أركان إقتصاد السوق الحر. تطبق أحكام قانون المنافسة على الأنشطة الإقتصادية عندما يتعلق الأمر بممارسات تندرج ضمن مجال الإنتاج أو التوزيع أو الخدمات منها أنشطة الإعلام السينمائي، وعليه قانون المنافسة يستغرق النشاط السينمائي بفروعه من نشاط الإنتاج ونشاط التوزيع ونشاط الإستغلال في قاعات العرض السينمائي باعتبارها أنشطة إقتصادية. من خلال التطبيقات المختلفة في القانون المقارن اتضح أنه هناك ما يمكن تسميته خصوصية قواعد المنافسة في مجال السينما وذلك ضمانا لحماية حق أساسي هو حرية الإعلام السينمائي. Abstract: The importance of the subject of the study is due to its connection with a basic subject that combines legal and economic importance, as the practice of any cinema activity is linked to competition. There is no doubt that competition is an essential pillar of the free market economy. The Competition Law and its provisions apply to economic activities when it comes to practices that fall within the field of production, istribution or services, including cinematic media activities. Accordingly, the Competition Law includes cinematic activity with its branches of production activity, distribution activity, and exploitation activity in cinema halls as economic activities. Through the various applications in comparative law, it became clear that there is what can be called the specificity of competition rules in the field of cinema
