مسؤولية الوسطاء الماليين في عمليات البورصة

Résumé: الملخص: باعتبار عمليات الوساطة المالية حق محتكر للوسطاء الماليين، فقد خصهم المشرع بنصوص قانونية، أهمها المرسوم التشريعي 93/10 المتعلق ببورصة القيم المنقولة المعدل والمتمم، حيث تقام مسؤوليتهم – مدنية، تأديبية، جزائية – متى خالفوا الأحكام التشريعية والتنظيمية المنظمة لعملهم، الأمر الذي يستوجب تطبيق عقوبات صارمة وردعية عليهم للحد من هكذا تصرفات تمس بأمن وسلامة المستثمر والبورصة بوجه عام. Abstract : considering the financial liason operations as a right monopolized by financial broker, legislator has singled them with legal texts, most important the legislative decree/10 which amended and complementary related to the stock exchange of movable values, so that their responsibility- civil, penal, disciplinary- will be established if they manipulate the legislative and regulatory provisions which organize their work, that’s why should applied a deterrent and tough punishments for them, in order to prevent such behaviors, which touch the security and safety of investor and stock exchange generally.
