السلطات الإدارية المستقلة كآلية لحماية المعطيات ذات الطابع الشخصي: دراسة مقارنة بين النموذج الفرنسي والجزائري

Résumé: تهدف هذه الدراسة لتبيان فعالية الدور الذي تؤديه السلطات الإدارية المستقلة في مجال حماية المعطيات ذات الطابع الشخصي، باعتبارها نموذجا فعالا في تمكين الحق في الحياة الخاصة، من خلال اجراء مقارنة بين النموذجين الفرنسي بواسطة اللجنة الوطنية للمعلوماتية والحريات "cnil"، والسلطة الوطنية لحماية المعطيات ذات الطابع الشخصي في الجزائر. وقد توصلت الدراسة للنتائج التالية: قدم المشرع الفرنسي ضمانات قوية لتجسيد نموذج حقيقي للسلطة الادارية المستقلة على المستوى العضوي على العكس تماما نظيره الجزائري. أما على المستوى الوظيفي: فكلا من الهيئتين تتمتع بسلطة تنظيمية واسعة جدا وصلاحيات رقابية قوية تمكنها من ضمان احترام النصوص القانونية اثناء معالجة المعطيات ذات الطابع الشخصي. This study aims to clarify the effectiveness of the role played by the independent administrative authorities in the field of personal data protection, as an effective model in enabling the right to private life, by making a comparison between the two French models by the National Committee for Informatics and Freedoms “CNIL” and the National Authority for Data Protection with Personality in Algeria. The study reached the following results: The French legislator has given strong guarantees to concretize its adaptation of the Commission to the independent administrative authority at the organic level. As for the functional level, the National Committee benefits from a very broad regulatory authority and strong supervisory powers that enable it to ensure respect for legal texts while processing personal data.
