المركز القانوني للسلطة الوطنية لحماية المعطيات ذات الطابع الشخصي: جمالية النص القانوني ومعوقات الواقع العملي

Résumé: في إطار التحولات التي تشهدها مهام الدولة في مختلف المجالات، قام المشرع الجزائري بإنشاء" السلطة الوطنية لحماية المعطيات ذات الطابع الشخصي"باعتبارها آلية مؤسساتية لحماية الحياة الرقمية للأشخاص، والملفت في ذلك أنه قد أطلق عليها وصف السلطة الإدارية المستقلة، وسعيا منها في التحقق من مدى صدقية هذا التكييف، توصلت هذه الورقة إلى أن الوصف الادراي لها ثابت فعلا، أما ذلك المتعلق بالاستقلالية فقد غلب على نصوصه الطابع التزيني للقاعدة القانونية وهو ما سيشكل عائقا حقيقيا في واقعها العملي. In terms of the changes witnessed by the government in all the different fields the Algerian has founded the national authority to protect personal data as it is an institution to protect people’s digital life. The notable things is that it was named the description of the independent administrative authority .In its attempt to investigate the credibility of this legislation this paper has concluded that the administrative description has real Impact. However the independent one was overcome by its embellished texts which will pose a real challenge to its practical reality.
