التجريم كآلية لحماية سرية المعاملات المصرفية في القانون الجزائري

Résumé: تعد سرية العمليات المصرفية أحد أهم المبادئ المستقر عليها منذ نشأة البنوك، حيث يقع على عاتق هذه الأخيرة مسؤولية المحافظة على المصالح الشخصية للعميل المتمثلة في كتمان أسرار معاملاته المصرفية؛ وبالنظر للأضرار التي تلحق بالعميل جراء إفشاء السر المصرفي حضي موضوع السرية المصرفية بالحماية الجنائية في معظم قوانين الدول، بما فيها الجزائر التي اعتبرت إفشاء السر المهني بصورة عامة جريمة معاقبا عليها وفقا للقواعد العامة المعمول بها في قانون العقوبات، كما خص السرية المصرفية بالحماية الجنائية بموجب الأمر رقم 03-11 المتعلق بالنقد والقرض الذي اعتبر إفشاء السر المصرفي جريمة معاقبا عليها بالعقوبات المنصوص عليها في قانون العقوبات. The confidentiality of banking operations is one of the most important principles that have been established since the creation of banks, as the latter are responsible for safeguarding the personal interests of the client represented by concealing the secrets of his banking operations; In view of the prejudice caused to the client as a result of the disclosure of banking secrecy, the subject of banking secrecy has benefited from criminal protection in most of the laws of countries, including Algeria, which considered the disclosure of professional secrets in general as an offense punishable under the general rules in force in the Penal Code; The legislator was also concerned with the penal protection of banking secrecy by virtue of ordinance n ° 11-03 relating to cash and credit, which considered the disclosure of banking secrecy as an offense punishable by the penalties provided for by the Penal Code.
