Résumé: تحظى الاسرار المهنية بحماية جزائية في قانون العقوبات، وذلك نظرا لاهميتها في الحفاظ على خصوصية الافراد واحترام الثقة والمصداقية في مهنهم ووظائفهم التي تمنحهم ثقة الجمهور، تعتبر المادة 301 من قانون العقوبات واحدة من المواد الاساسية التي تهتم بحماية السر المهني بشكل جنائي، وتعتبر وسيلة ردعية تعبر عن حق المجتمع وتتجاوز حقوق الفرد. تُفرض العقوبات على أولئك الذين يعتدون على مصلحة المجتمع من خلال سلوكيات غير سوية تؤثر على أمنه واستقراره. تتمثل المعالجة التشريعية لافشاء الاسرار المهنية بموجب المادة 301 من قانون العقوبات في تحديد عناصر التجريم والعقاب. يتم تحليل أركان المادة وإبراز القصور المحتملة في تطبيقها، وتقديم حلول وفقا للمقتضيات السياسة الجزائرية التي تعتمد على معايير التجريم والعقاب، وذلك لتعزيز حماية الاسرار المهنية والحفاظ على سرية المعلومات ذات الطابع المهني. The study focuses on the criminal protection of professional secrets in the Penal Code, highlighting their significance in maintaining individuals' privacy and upholding trust and credibility in their professions and positions. Article 301 of the Penal Code is a fundamental provision that deals with the criminal protection of professional secrecy, serving as a deterrent that represents the rights of society beyond individual rights. Penalties are imposed on those who engage in unethical behaviors that harm the interests of society and affect its security and stability. The legislative treatment of disclosing professional secrets under Article 301 of the Penal Code involves identifying the elements of criminalization and punishment. The study analyzes the components of the article and highlights potential shortcomings in its implementation. Solutions are presented based on Algerian policy that relies on criminalization and punishment standards, aiming to enhance the protection of professional secrets and preserve the confidentiality of professionally sensitive information. .
