قراءة تحليلية في الأحكام المتعلقة بالتصويت التفضيلي لانتخاب أعضاء المجلس الشعبي الوطني

Résumé: في محاولة من المؤسس الدستوري الجزائري والمشرع الانتخابي الجزائري لأخلقة الحياة السياسية، ضمن إطار العدالة في التعبير عن توجهات الناخبين، اعتمد الأمر رقم 12-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات نظام التصويت التفضيلي لانتخاب أعضاء المجلس الشعبي الوطني، لما يحققه هذا النظام من القضاء على الكثير من مظاهر الفوضى التي سادت الحياة السياسية في مرحلة سابقة. إلا أنه وبالمقابل لا يخلو اعتماد هذا النظام من تأثير سلبي على هيئة الناخبين خاصة زيادة عدد الأصوات الملغاة، وعلى التمثيل البرلماني السياسي والنسوي، وعلى الساحة السياسية سواء على الأحزاب السياسية أو على الحياة النيابية. : Both the Algerian constitutional founder and the Algerian electoral legislator try to make the political life more ethical within the framework of the justice in expressing the voters’ orientations. The order 21-01 including the organic law which related to the electoral system has been relied as preferential voting system to elect the National Assembly Members. This system can eliminate many aspect of chaos that prevailed the political life in the previous period. On the other hand, this new system has a negative effect on several levels; first on the electorate especially the increase of cancelled votes number. Then on the parliamentary representation in both political and female. Last but not the least, on the political parties or on the political field.
