النظام القانوني لانتخاب أعضاء المجلس الشعبي الوطني على ضوء الأمر 21-01 المتضمن القانون العضوي للانتخابات

Résumé: إن المجلس الشعبي الوطني هيئة تمثيلية تستمد شرعيتها من انتخاب الشعب لها مباشرة، وتتولى مهمة التشريع والرقابة على أعمال السلطة التنفيذية في إطار الدستور. وإذا كان لها هذا الدّور المهم فإنها لا تستطيع القيام به إلاّ بواسطة أعضاء البرلمان. لذلك تولى قانون الانتخابات التفصيل في معرفة كيفية حصول الفرد على مقعد في المجلس الشعبي الوطني. وبصدور الأمر 21-01 المتضمن القانون العضوي للانتخابات في ظل ظروف خاصة نتيجة الحراك الشعبي، فإنه من جهة حمل الإضافة والخصوصية للفوز بمقعد في المجلس الشعبي الوطني، ومن جهة أخرى حاول ابعاد المال الفاسد الذي أفسد العملية الانتخابية وشجّع الشباب على ممارسة السياسية ودخول المنافسة الانتخابية. The People’s National Assembly is a representative body that derives its legitimacy from the people’s direct election. If it has this important role, it can only play through members of Parliament. Therefore, the electoral law detailed how an individual can obtain a seat in the National People's Assembly. With the issuance of Order 21-01 that includes the organic law for elections under special circumstances as a result of the popular movement, on the one hand it carried the addition and privacy to win a seat in the National People's Assembly, and on the other hand it tried to remove the corrupt money that corrupted the electoral process and encouraged young people to practice politics and enter the electoral competition
