مسؤولية البلدية بفعل التجمهر في ظل القانون رقم: 11-10. The Municipality's Responsibility For Gathering Under Law No. 11-10

Résumé: إن المشرع الجزائري في القانون رقم 11-10 المتعلق بالبلدية قام بإسقاط مسؤولية البلدية عن جريمة التجمهر بعدما كانت المسؤولية مؤسسة في ظل القانون رقم 90-08، وأن هذا الإجراء يشكل عزوفا عن مساءلة البلدية وتقليص مسؤوليتها نحو توحيد مسؤولية الدولة بفعل جريمة التجمهر، غير أن هذا التحول من شأنه أن يطرح اشكالا حول استقلال مسؤولية البلدية نتيجة الاعتراف بالشخصية المعنوية لها والاهتمام بالشؤون المحلية التي تضطلع بها من ناحية، وهو الأمر الذي قد ينعكس عن الدعاوى القضائية واختصاصها النوعي والإقليمي من ناحية أخرى. Abstract : The Algerian legislator in Law No. 11-10 related to the municipality dropped the municipality's responsibility for the crime of assembly after it was established under Law No. 90-08, and this action constitutes a reluctance to hold the municipality accountable and reduce its responsibility towards unifying the state's responsibility for the crime of assembly. This transformation would raise questions about the independence of the municipality's responsibility as a result of the recognition of its moral personality and concern for local affairs on the one hand, which may be reflected in lawsuits and its specific and regional jurisdiction on the other.
