حل المجالس البلدية المنتخبة

Résumé: إن حل المجالس البلدية المنتخبة من أنواع الرقابة الوصائية على المجلس الشعبي البلدي، وأخطر أنواع الرقابة هي ايقاف المجلس البلدي وذلك بإنهاء حياته قانونيا وتجديد أعضاءه من الصفة التي يحملونها، مع بقاء الشخصية المعنوية لهاته المجالس البلدية وذلك وفقا للحالات المذكورة في القانون وقد أخذ المشرع الجزائري بالحل –اقتداء بالنظام الفرنسي في الرقابة على الهيئات اللامركزية- منذ صدور أول قانون للبلدية بموجب الأمر رقم 67_24 المؤرخ في 18 جانفي 1967 المعدل والمتمم بموجب القانون رقم 81_09 المؤرخ في 04 جويلية 1981 الذي حدد الجهة المختصة بالحل. والآثار المترتبة عنه دون تحديد إجراءاته ولا حالاته باستثناء حالة ضم البلديات بينما قانون البلدية رقم 90_08 المتمم بموجب الأمر رقم 05_03 قد حدد ضوابط الحل، وأضاف قانون البلدية الجديد رقم 11/10 4 ضوابط للحل .The dissolution of elected municipal councils is one of the types of guardianship control over the Municipal People's Council, and the most dangerous type of control is the suspension of the Municipal Council by ending its legal life and renewing its members from the capacity they hold, while the moral personality of these municipal councils remains in accordance with the cases mentioned in the law, and the Algerian legislator has taken the solution - Following the example of the French system for oversight of decentralized bodies - since the issuance of the first municipal law pursuant to Order No. 67_24 of January 18, 1967, amended and supplemented by Law No. 81_09 of July 04, 1981, which specified the competent authority for the solution. And the implications of it without specifying its procedures or situations, with the exception of the case of joining the municipalities, while the new municipality law No. 90_08, supplemented by Order No. 05_03, has defined the conditions for dissolution,The new municipal law No. 11/10 added 4 controls to the solution.
