دور مســــرح الجريمة فــــي الإثبــــات الجنائـــي

Résumé: ملخـــــص من خلال هذه الدراسة يظهر أن المجتمع يبقى دائما مهددا من طرف الخارجين عن القانون وذلك بدليل الجرائم التي ترتكب يوميا في حياتنا, والتي هي على مستوى عالي من الخطورة نظرا لتطور وسائل ارتكاب الجرائم اعتمادا على التطور العلمي والتكنولوجي الذي تشهده البشرية, الأمر الذي أدى بالمقابل بالباحثين والدارسين في هذا المجال التفكير في اللجوء إلى كل ما يفيد في التحقيق ومن بين هذه الأساليب التي اعتمدها جل المحققين في مجال الإجرام وفي معظم دول العالم خاصة منها الدول المتطورة, وهي الاعتماد على مسرح الجريمة الذي يتم ارتكاب فيه الفعل المجرم أو كل ما له علاقة بتنفيذ السلوك المجرم من خلال الانتقال إليه بمجرد وقوع أو العلم بجريمة ما خاصة إذا كانت تشكل خطورة على المجتمع برمته, والقيام بمعاينة المكان الذي ارتكبت فيه الجريمة والمحافظة على هذا الأخير, لهذا نجد المشرع الجزائري كغيره من المشرعين قد ألزم القائمين بالبحث والتحري عن الجرائم ومرتكبيها وهم ضباط الشرطة العلمية بالانتقال بمجرد وقوع جريمة خاصة الخطيرة منها وفي الجنايات إلى مسرح الجريمة واتخاذ الإجراءات اللازمة وكذا انتقال وكيل الجمهورية وحتى قاضي التحقيق إن أمكنه ذلك. Through this study , It appears That society always remains threatened by outlaws, as evidenced by the crimes That are committed Daily in Our lives ,which are at a high level of the means of committing crimes depending on the scientific and technological development witnessed by humanity, which in return led the researchers and scholars in This Field think about resorting to everything That Is useful in the investigation, and among these methods adopted by Most countries of the world, especially developed countries, which is relying on the crime scene in which the criminal act is committed or everything related to its implementation criminal behavior by moving to it as soon as the occurrence or knowledge of a crime, especially if it poses a danger to society as a whole, and inspecting the place where the crime was committed and preserving the latter. The scientific police move as soon as à crime scene and take the necessary measures, as Wells as the Transfer of the representative of the republic and even the investigating Judge if He Is able to do So
