حماية الطفل في ظل أحكام القانون رقم 15-12

Résumé: يعتبر الطفل العمود الأساسي في بناء الأسرة، هذه الأخيرة التي تعتبر الخلية الأساسية في بناء المجتمعات، لذلك فقد ارتكزت دراستنا حول حماية هذا الطفل باعتباره رجل الغد، وعمود المجتمع، وهذا في ظل القانون رقم 15-12 المتعلق بحماية الطفل الصادر سنة 2015، ولعل أهمية موضوع الدراسة تتمثل أساسا في معرفة كيف حمى المشرع الجزائري الطفل سواء من الناحية الاجتماعية أو حتى من الناحية القضائية، وسواء كان هذا الطفل في خطر أو جانحا. وقد خلصنا في نهاية الدراسة إلى جملة من النتائج نذكر منها أنّ المشرّع الجزائري قد أوكل مسألة حماية الطفل الجانح والطفل في خطر إلى قاضي الأحداث على مستوى مختلف الجهات القضائية، كما توصّلنا أيضا إلى أنّ مسألة محاكمة الأحداث خصّها المشرّع الجزائري بإجراءات خاصة سواء أثناء مرحلة التحريات أو حتى في مرحلة المحاكمة. Therefore, our study was based on protecting this child as the man of tomorrow, and the pillar of society, and this is in light of Law No. 15-12 on Child Protection issued in 2015, and perhaps the importance of the subject of the study is mainly to find out how the Algerian legislator protected the child, whether from a social or even from a judicial point of view, and whether this child is in danger or delinquent. At the end of the study, we concluded a number of conclusions, including that the Algerian legislator has entrusted the issue of the protection of delinquent children and children in danger to the juvenile judge at the level of various judicial authorities. we also concluded that the issue of the trial of juveniles has been singled out by the Algerian legislator with special procedures, both during the investigation stage and even at the trial stage.
