النظام القانوني للمنازعة الناشئة عن عقد المناولة في الصفقات العمومية

Résumé: نشأت المناولة ضمن نظرية العقود الخاصة، ثم انتقلت إلى العقود الإدارية، و رغم ذلك احتفظ عقد المناولة بصفة العقد الخاص، تضمن تنظيم الصفقات العمومية شروط المناولة في مجال الصفقات، حيث يؤدي عقد المناولة إلى قيام علاقة تعاقدية ثلاثية، بين كل من المصلحة المتعاقدة، المتعامل المتعاقد ، و المناول، فكون لكل طرف حقوقه و التزاماته. إن ازدواجية البيئة القانونية التي نشأ فيها عقد المناولة، أدت إلى جعل المنازعات الناجمة عنه ذات طبيعة متباينة، فبعضها منازعات إدارية، و البعض الآخر منازعات عادية.
